No. Because the NY courts site makes it clear that conviction happens
BEFORE the sentencing and BEFORE the pre-sentencing report:
'The report is made after the conviction and before the date for
Sentencing in felony and serious misdemeanor cases.'
That means that sentencing happens AFTER the report, which itself
happens AFTER conviction.
