The way our government works, Congress passes laws creating agencies 
like EPA, give them a purpose, and then allow them and require them to 
create regulations within the scope of the agency according to rule 
making laws of Congress. Congress monitors the agency, and they can 
adjust funding and pass additional laws on its responsibility as 
Congress sees fit.

As I remember, Obama decided coal use was within the EPA's scope, so he 
had them make new regulations. The regulations were extensively argued 
during public comments. EPA was challenged that coal was outside the 
EPA's mission. Courts decide it was. Then Congress argued over it.

Google makes it easy to the law creating EPA. All the rules EPA made are 
in something called CFR so it is easy to find and read the 'rules' Obama 
put in place.

States retain some control over what happens in their state, Not all 
rules are federal. And businesses choose what is most profitable.
